How do I remove an original criminal charge that was lowered to a lesser charge. I.E. a second degree felony to a third?
My son just turned 23. at 15 he was convicted of grand theft for breaking into a house w/other boys. is it better to try to expunge or seal this juvenille record. he has lost 2 good job opportunities
In Florida, if a child hasn't been classified as a habitual juvenile offender, committed to a juvenile correctional facility, or was not charged as an adult, juvenile records are expunged automatically when the offender reaches the age of twenty-four. If you need to get it sealed/expunged earlier, because of job opportunities, then your son would have to meet the statutory eligibility requirements. Basically, he would have to be able to answer "no" to these three questions:
1. Has he been adjudicated guilty of any crime, in any state?
2. Has he ever sealed/expunged a record
