The State of Florida is cracking down on reckless drivers and anyone who participates in a street race.
A reckless driver is defined in Florida statute 316.192 as “Any person who drives any vehicle in willful or wanton disregard for the safety of persons or property.” This can include fleeing the police and racing on a public street or highway.
Racing on the highway is defined in Florida statute 316.191 as operating one or more motor vehicles across a common course for the purpose of comparing speed or power. This can include any spectator who knowingly watches or participates by gambling or riding as a passenger in a racing vehicle.
A conviction for either of these offenses is a first degree misdemeanor that can result in a fine of up to $1,000 and a jail term of up to one year. A conviction of racing can also result in impoundment of your vehicle for up to thirty days and a second conviction within five years can result in seizure and forfeiture of your vehicle.
As of October 1, 2009, Florida statute 318.18(5) (c) increases the fines for both of these offenses by $65. The increased fines are a civil penalty that will go to fund hospital trauma centers throughout the state.
The new statute also requires that drivers convicted of either of these offenses attend a department approved driver improvement course within 90 days of notification by the Florida Department of Highway Safety and Motor Vehicles.
If either of these offenses resulted in a collision and this was your third collision within a 36 month period, the traffic school will have to include a behind-the-wheel portion and you must successfully pass a behind-the-wheel exam in order to keep your driving privileges. This course must be completed within 90 days after receiving notification from the department.
If the traffic school courses are not completed within 90 days of notification by the department, your driving privileges will be suspended.
