Presently as General Secretary of Chandigarh Social Welfare Council, an NGO, am working in the field of up gradation of infrastructure and regularization of the General Power of Attorney holders in cooperative housing societies at Chandigarh.At my initiative, Chandigarh Administration has done a re-look into the matter raised by me. The rules sought to be applied till now have been observed as "repealed" by the JSF, Chandigarh Administration, yet some of the junior level functionaries are passing on the matter to their seniors in a mechanical manner and hence the woes of the hapless GPAs have yet to be redressed by the Administration. I shall continue writing on the subject and every subsequent article shall endeavor to bring out the anamolied

At last, the GPA holders in cooperative house building societies seem to relax his mind on affecting transfer of the share/flat in his name. The relentless agitation on the issue by me has brought the desired effect and the administration modified its order of the 15th August,2009. The latest notification on the subject was issued on 2nd March 2009, hours before the model code of conduct was enforced in the backdrop of Parliamentary elections 2009.
As per the modified order of the administration, the transfer fee in respect of the Category A flat has been fixed at Rs. 50,000/-, for category it is Rs. 25000/- and for Category C it is Rs. 15000/- only. Though the neighboring states of Punjab and Haryana Charge much lower fee for affecting transfer on the name of the GPA, yet its was not resented by me. After all, the administration has been instrumental in lowering the transfer fee and waived the clause of the “unearned increase” which administration earlier sought to be levy on the GPA holder in cooperative house building societies.
The Chandigarh Administration left the implementation of the policy of transfer notified by it for affecting transfer of share/flat in the name of the GPA holder in the cooperative house building societies to the wisdom of the managing committees of the societies. The sane managing bodies of the societies adopted the procedure of inviting objections to the transfer by inserting advertisements in the leading newspapers. On expiry of the period stipulated in the advertisement, societies transferred the shares/flats in the name of the GPA holder.
However, home societies having crooked bent of mind were not inclined to implement the policy of the Chandigarh administration in letter and spirit. Disinclined, owing to stakes in the running of the affairs of the society, such societies did not commence the process of transfer and advanced various frivolous grounds for non-implementation of the Policy. This caused panic in the minds of the GPA holder who made a beeline to my residence.
My various representations on the problems that the GPA holders faced in getting the share/flat transferred on their names again evoked sympathy of the Ld. Home secretary cum secretary Cooperatives. Ld. Home Secretary issued strict directions to managing bodies of the cooperative house building societies to implement the policy in letter and spirit. He also cautioned the GPA holders not to pay even single penny besides the stipulated transfer fee for affecting transfer of the share/flat in their names.
In this process, Chandigarh Administration dissolved some of the management bodies of the cooperative house building societies and replaced these by Administrators who are now responsible for implementing the policy and affect transfer of share/flat in the name of the GPA holder. Administration has further mooted setting up of Grievance Redressal Cell headed by a senior officer from the Cooperative Department
The officer shall be available every day to hear the grievances of the members of the cooperative housebuilding societies and act as Nodal Officer, Further modalities are being worked out to hold weekly Lok Adalat to sort out the issues facing members of the cooperative house building societies. Though these measures are being formulated yet the measure of the Chandigarh Administration has raised high hopes among the affected persons.
Now the curtains on the issue of the regularization of the GPA holders in Cooperative House Building societies are Really drawn and fate of the GPA holders in the Cooperative House Building Societies seems set aboard.
