Indemnity Insurance Simplified

Many people are confused when confronted with a discussion about personal indemnity insurance or professional indemnity insurance but the concepts involved are pretty straightforward and easy to understand.

You would consider purchasing indemnity insurance as a protection against legal claims that could be made against you by  a third-party for any loss they may have incurred as a result of damage or injury you may have caused to that third-party. Simply put, it covers you if you are held responsible for damages when sued by a third-party. 
However, the insurer not only pays for any damages, they will also usually pay for any legal bills that the insured might incur in defending any court action. In fact, they will also usually provide assistance in defending any action and will pursue recovery of costs if you are successful in your defense.

There are generally two types of indemnity insurance that most individuals will need to consider, personal and professional.

Professional indemnity insurance is designed to protect professionals such as doctors, lawyers, consultants, etc... Often called Errors and Omissions Insurance, it protects against the financial impact of being sued for damages that are deemed to have been caused to a client through either action or inaction on the part of the professional. In this case, the insurance company indemnifies the professional against any legal liability as a result of an ommission or error on their part while performing work for a client which results in the client suffering a loss.

Personal indemnity insurance provides similar protection ot individuals but the damages are not related to work done for clients but rather protects against legal action resulting from some act of negligence on the part of the insured that caused damage to a third-party. A child injured as a result of having left access to your swimming pool open or a landlord's negligence resulting in injury to a tenant, are examples that would be covered by personal insurance. As with professional insurance, any losses and legal expenses would be covered by the insurance company.

As our society becomes more and more litigious it becomes more and more important to have indemnity insurance in place and of a sufficient amount to cover any possible legal fees and losses should you be sued. Make sure to discuss your coverage every year with your insurance representative.
