HIPAA Privacy Regulations

The Department of Health and Human Services under the Health Insurance Portability and Accountability Act issued Privacy Regulations with the purpose of protecting the privacy of American patients' health information in numerous ways and creating additional rights for patients regarding their healthinformation.

The chief intend of these regulations is to give full control to consumers over their health information; create "boundaries" around how medical records can be used and disclosed; guarantee the security of personal health information; and establish accountability for the use and release of medical records. A proper balance between public responsibilities with privacy protections is also maintained by these regulations.

It's a duty of any healthcare provider to safeguard patient information. According to the existing law, patients possess the right to sue health care providers who invade their privacy or publish private information about them. New privacy standards will not add to privacy protection; instead, they will add new health care costs and bureaucracy.

Under HIPAA Privacy Regulations, a right is granted to individuals to request that a covered entity correct any inaccurate PHI. It also requires covered entities to take reasonable steps to ensure the confidentiality of communications with individuals. Also it is essential that the covered entities notify individuals of uses of their PHI. Covered entities must also keep track of disclosures of PHI and document privacy policies and procedures. A Privacy Official and a contact person responsible for receiving complaints and train all members of their workforce in procedures regarding PHI must be appointed.
