Pre-employment screening services can provide a service to employers that they would find difficult to provide for themselves. There are many aspects of business that can be carried out adequately by companies without paying for internal or external professional services. Pre-employment screening is not one of those, and though many employers try, the consequences of failure can be very high.
This is an increasingly litigious society, as ordinary people come to understand the financial benefits that lawsuits of all kinds can bring them. Injury or harm due to irresponsible or negligent hiring is one of these areas where employees can take legal action and gain financial reward for doing so.
Computer fraud is becoming more commonplace as the computers themselves become more and more powerful, requiring highly specialized and trained employees to run them. It is no longer sufficient to carry out an interview followed up with a few phone calls to confirm references, and there have been sufficient incidences of workplace violence and internal computer fraud for such simple pre-employment procedures to be considered inadequate. Ignorance of an employee’s background and behavior is not an excuse if insufficient screening has been carried out.
This sort of background checking is best carried out by those experienced and trained to do so. It is a professional job and the number of companies using professional pre-employment screening services has risen sharply over the past few years. It is not a job for the average company management employee, and it is unrealistic for any business to consider it so.
The legal knowledge required alone is worth the professional fee. Legislation such as the Fair Credit Reporting Act (FCRA) and the Americans With Disabilities Act (AWDA) can be complex for the average manager to understand, and many states have made their own additions to the federal Acts.
The purpose of the FCRA is to ensure the fair dissemination of information about people to others requiring it, and that the information provided, and the use to which it is put, is properly regulated. Part of this requirement is to ensure that prospective employees have given permission for certain types of consumer information to be provided to agencies requiring it. Professional screening agencies can make conforming to this legislation easy for you by taking it out of your hands.
The AWDA protects against discrimination of disabled people while seeking employment. It is useful to have a professional firm handle this since it is frequently necessary to turn down the disabled for other reasons. You do not want to handle this in the wrong way or you could find it difficult to defend against the potential repercussions.
There are several background checks that can be made, such as drug screening, driving offenses and the candidate’s criminal record. You can also check their credit rating, which could be useful if part of the job brings them into contact with a lot of money. Computer whiz-kids with severe financial difficulties could be a problem if their job entails looking after your computerized bank accounts.
Pre-employment screening services can take a lot of weight off your shoulders where hiring new employees is concerned. Not only is the legislation getting more complex, but also the penalties for failing to carry out suitable background checks are too high for you not have them done professionally. Do yourself a favor, employ an agency and relax.

The Federal Credit Reporting Act (FCRA), state statutes, reporting guidelines and applicant disclosures all must be adhered to as part of the process. It's critical to follow these procedures as you don’t want to find yourself in legal troubles. The FCRA sets forth the guidelines for background investigation companies also known as Consumer Reporting Agencies. Essentially it protects the consumers' right to privacy and fairness when preparing consumer reports on individuals. State statutes: States often set their own rules pertaining to the use and dissemination of consumer information. What may be allowed as a reportable offense in one state may not be legal in another. When performing a California background check, the state civil statute (California's Investigative Consumer Reporting Agencies Act) must be followed as there are a variety of restrictions imposed. A misdemeanor marijuana conviction older than 2 years is not reportable and therefore an adverse action decision may not be made based on this offense. Criminal convictions and credit data are not allowed to be reported beyond the 7 year period from the date of disposition. Arrest only records are only deemed reportable if the case is pending but if the arrest did not result in a conviction, it can not be used. An applicant authorization must stipulate that the candidate has a right to request a copy of his or her report. Consumer notification: Each applicant must be provided a disclosure (prior to initiating a background check) notifying them of their rights including the ability to dispute information. Pre-adverse action: Prior to making an adverse decision, an applicant must receive a disclosure that outlines "A summary of rights under the fair credit reporting act" and a copy of their consumer report must be provided. Adverse action: Once a decision has been made to take an adverse action, the applicant must be provided the following: The name, address and phone number of the consumer reporting agency. A notice of the individual's right to dispute any information they believe to be invalid and his or her right to obtain an additional free copy of the report within 60 days. Before choosing an outside vendor to conduct your background employment screening, make sure they provide compliance services and adhere to your state statutes otherwise you will be required to apply federal and state law to each and every report that you receive. By hiring a professional screening firm, you can save yourself a lot of headaches!
