The cost of car insurance is set to rise steeply in 2009 as insurers struggle to meet the cost of a growing number of personal injury claims. As victims of road traffic accidents become increasingly proactive in seeking compensation, the driving community as a whole is beginning to feel the pinch.
Figures released at the start of the year estimate that motorists are likely to see their premiums rise by somewhere between 10 to 11 per cent over the course of 2009. This comes on top of rises in 2008, which are calculated to have elevated the average cost of a policy to £486; a 9 per cent increase on the previous year.
The escalating costs have in part been attributed to the increased price of fraud which is estimated to have inflated the average premium by nearly a fifth over the course of 2008. Another factor cited is the cost of accidents in which the other party was uninsured. In both instances, the financial burden is ultimately born by the drivers who pay their premiums, as the insurer inevitably passes on the extra cost.
The biggest reason for the growing cost of premiums is, however, the vast increase in the number of personal injury claims filed during the course of the last few years. Insurers are finding themselves liable for huge medical cost and legal fees, resulting in hefty compensation payouts.
The willingness of more and more law firms to undertake claim work under conditional fee terms, known colloquially as "no win, no fee" agreements, has meant that more people are in a position to instruct an injury lawyer who is likely to win their case. Therefore, not only are the victims of driving related injuries more likely to pursue their claim, they now also have an increased chance of winning. As a result, insurers are finding themselves liable for both the value of compensation claims and the cost of the legal fees on both sides.
The culture of pursuing personal injury claims has, therefore, become something of a double edged sword for motorists. It is reassuring to know that in the case of serious injury there are safety nets in place to ensure that financial costs and losses will be met. However, the flipside of this is that all motorists now find themselves facing an extra large bill in a year when the finances of many are already stretched.
