Planning Appeals Recovery Criteria Revisions

Have you recently decided to add-on to your current property or build a new property, but not sure about the permit appeals process? Are you totallly confused? The following information may be the most vital information you have read all year. The following is a paraphrased statement that was submitted in June of 2008 to the House's Parmjit Dhanda, the Parliamentary Undersecretary of State, concerning revisions to criteria involving planning appeals recovery.

England's decisions on planning appeals

Inspectors make the decisions on most of England's planning appeals. There is however a small number of planning appeals that are decided by the Secretary of State for Communities and Local Government. This is a due to the development itself being controversial and / or large. Every year approximately 27,000 appeals are filed. The Secretary of State determined 110 appeals in 2007 alone. This statement was made to publicize planning appeals recovery policies by the Secretary of State. It was put in place of the old policy which stated that determination by the Secretary of State would be made on recovered appeals. The old policy was set out in July of 2006 by the House of Commons. Upon review of the old policy changes were needed and therefore introduced. New criteria introduced consisted of relating to the World Heritage Sites while the others relate to energy and climate change.

Changes for the Secretary of State

Any appeal involving the following will now be considered by the Secretary of State:

  • Cases other than the following may now and then merit recovery due to extenuating circumstances
  • Proposals that could possibly have an impact, adverse in nature, on authenticity, integrity, significance and value of a World Heritage Site
  • Significant proposals concerning the working and winning minerals
    • Proposals involving major Green Belt development
    • Proposals entailing usage of a main town centre
      • Significant proposals involving the Government's energy policies and climate change programme
      •  Proposals and that could present issues legal difficulties and or developments control issues
      • Any proposals that could cause significant national or regional controversy
      • Proposals involving development of significance other than that of local importance

Once again this is paraphrased, and significantly shortened.
