  1. Mediation – this method requires the parties to sit down and meet with a third party who guides them in achieving the proper solution to their dispute. The mediator only helps by weighing the strengths and weaknesses of both parties’ arguments, and has no authority to decide for them.

 

With the help of the mediator, the parties may take either one’s solution, they may meet halfway, or they may even think of a different answer to their queries. It is totally up to them. The topics taken up here is usually confidential. The discussions and materials are not admissible as evidence in court.

 

Since the decision-making is left to the will of the parties, they may scrap out the agreed solution and come up with another one, in case the old solution fails.

 


  1. Arbitration – the arbitrator acts like a judge. In this method, parties submit to the arbitrator, a third party, their conflicting arguments and claims. After the hearing and after a careful study of the contentions of both sides, the judge makes the decision based on the law and usually chooses the solution given by the party who presented the strongest case.

 

Parties are bound to follow the decisions of an arbitrator. After the verdict has been laid down, the parties cannot anymore come up with another solution.

 


  1. Litigation – when all other methods fail, the parties can submit their differences to the court. The judge carefully examines the facts of the case, the issues involved, as well as the contentions of both sides. From these, the judge, applying the necessary and applicable business laws shall give out his ruling. The verdict laid down by the tribunal, absence of an appeal, shall be final and executory.
