An Overview on the Nature of Active Warrants

When searching for a criminal record about a person either on the internet or right at the precinct or courthouse, there are a lot of determining factors that greatly affects how the criminal record of that person is being sort out and prepared. When these factors are present in a person’s search for criminal record, it influences the way the search is being conducted and the result generated by such searches. Among these factors that can either make or break a person’s search about someone else’s criminal history is the presence of active warrants issued against him or her by the court. There are several reasons why a person could have an active warrant against him especially if that person has committed some violations against the law.

Before a warrant becomes active, the court must first issue a warrant against the person whom the court found some probable cause to pursue the issuance of a warrant. Most of the time, warrants issued against an individual are arrest warrants requested by certain law enforcement agency due to suspicion about a criminal involvement of the subject. The requesting party has first to submit a case against the subject with supporting evidence which in turn gets reviewed by the judge to evaluate for merits of warrant. If the judge will be able to rule that there is a probable cause in which to issue a warrant, the appeal of the requesting party for an arrest warrant will be granted by the court.

Warrants issued by the court becomes an active warrant if the requesting party, e.g. a police agency, will then decide to pursue the case and search for the subject in question to be served with the warrant of arrest. But the period between the issuance of the warrant until the serving of the warrant to the subject makes it an outstanding warrant. After the warrant of arrest has been issued and the person in question has been taken into custody of the police, that person will be subjected for interrogation and depending on the amount of the evidence against him; he or she may go to trial to defend the accusations charged against them.

Active warrants are legal documents allowing an officer of the law to perform legal actions against the subject in question. There are instances where the officer is unable to issue the warrant to the subject because of several reasons. First is that the subject may have changed residence and has left no forwarding address or that the subject of the warrant has prior knowledge about the existing warrant against him and instead of facing it and refute the charges against him, the individual chose to dodge the law which in this case, only broaden the criminal charges against him. If the warrants are not served to the subject in question, it will remain in the warrant records of the court until the time the subject is captured and brought into custody. If the subject continues to hide from the law, there are chances of his record being put into the wanted list.
