Domestic Assault - An Explanation

Domestic assault can be defined as a pattern of abuse or abusive behaviors by either or both partners in a relationship such as family, friends, dating, marriage, or people living together.

Incident

In a majority of situations, domestic charges stem from either a particularly heated argument or a physical confrontation between spouses. In several of these cases, it is the woman that makes the call to 911 to report her husband's abusive behavior towards her. The abusive behavior can be either actual physical violence, or the threat of imminent violence. Police will report to the scene to investigate the call and interview both spouses. Usually the abusive spouse will be arrested and charged with domestic violence.

Degrees

Domestic assault can fall under three degrees. First degree domestic assault can be defined as: if one partner attempts to murder or consciously causes or makes an attempt at serious bodily harm to a household or family member or an adult who either has been or is in an ongoing social relationship of an intimate or romantic kind.

First degree domestic assault is a Class B Felony. If the victim sustains serious physical harm, then it is considered a Class A Felony.

Second degree domestic assault can be defined as: when a household or family member of either a past or current close relationship attempts to cause or consciously causes bodily harm by any means; by use of a fatal weapon or dangerous instrument, or by physical action such as strangling or choking. Bodily harm can also include heedlessly causing physical injury or heedlessly causing physical injury with a fatal weapon.

Second degree domestic assault is a Class C Felony.

Third degree domestic assault is a combination of first and second degree assault as well as the addition of the suspect in question placing "the victim in apprehension of immediate physical injury;" or heedlessly acts in a manner that creates a great risk of death or serious bodily harm to the victim; or consciously causes physical contact with the knowledge that the other person knows that the physical contact is offensive; or knowingly tries to cause or causes the isolation of the victim by "unreasonably and substantially restricting or limiting" the victim's ability to reach out for help either through another person, communication device or taking them to a place where they will be isolated.

Third degree domestic assault is a Class A Misdemeanor.
