Power of Attorney in Scotland

When a Power of Attorney is signed, it authorizes another individual to do certain things which the authorizing person is unable to do due to a lot of reasons. There are a lot of circumstances when the authorized person can take certain actions in personal and professional fronts. If the authorizer is suffering from mental disorder, learning disability, physical disability, period of absence or abroad for a very long time, or inability to communicate then the authorized person according to the Power of attorney can take and implement decisions regarding property, business etc. A power of attorney can be signed for a minor who is a child and can't take major decisions in life.

There are a lot of legal and practical issues which are taken into consideration when a proper Power of Attorney in Scotland is to be drafted. A Power of Attorney can permit another person to help in his or her financial affairs and in some cases, a greater degree of supervision is required as the case may be. There are different types of Power of Attorney Scotland. A simple Power of Attorney is the one when one person can delegate one or more responsibilities to another person if he is abroad for a long time. Various power or powers can be delegated to another person as decided by the person who is delegating. The second type of Power of Attorney is Continuing power of Attorney "CPA" which deals exclusively with financial power. Continuing power of Attorney is done when the person is worried about being unable to make decisions in future. The third type of Power of attorney is Welfare Powers of Attorney which deal mainly with the power to make decisions regarding the health or personal welfare and strictly not any financial or property decisions. A fourth type of Power of Attorney also exists in Scotland which is called the Combined continuing and welfare Power of Attorney which is a combination of Continuing and Welfare Power of Attorney. In a Combined Continuing and Welfare Power of Attorney, all affairs including management of estate in the event that you become incapable in terms of the adults with Incapacity Act 2000 is covered.

There are a lot of benefits of Power of Attorney which can be useful. Firstly, a Power of Attorney is a safeguard in case of any mishappening in future so that your near and dear ones do not suffer due to your absence. Secondly a Power of Attorney does not hold good until it is drafted and granted. Thus, it can be prepared and kept and can be granted only when needed.
