Should I Hire a DUI Lawyer?

Being arrested for drunk driving is something that shouldn't be taken lightly.  More often than not, people think that it's ok to try and defend their DUI case on their own.  Contrary to popular belief, a DUI case can be quite complex.  There are many factors involved that need to be investigated.  Although it's isn't required, it's highly recommended that you do hire a DUI lawyer, especially if this is your first drunk driving arrest.

Here are a few reasons why you should consider hiring a DUI lawyer:

  • A lawyer is more aware of the current drunk driving laws, processes, and procedures.  He/she knows what needs to be done in order to investigate your DUI case.  Wouldn't you want someone by your side who can present your case to the judge and the court with confidence?
  • An experienced lawyer who specializes in drunk driving is resourceful.  He/she how to get the information required that will help you with your case.  If your case includes circumstances that are not typical, a lawyer will know what information or resources to look into.
  • A good DUI lawyer can help get your sentence reduced.

Here are some issues a DUI lawyer will investigate:


1)  Does the defendant have medical issues?   

2)  What is the defendant's occupation?  There have been a few cases in which people were arrested for a DUI when in fact, they didn't even have one drink. People in certain occupations are exposed to chemicals that could affect their B.A.C. (Blood Alcohol Content) reading in a breath test.  In California the legal limit is 0.08%. 

3)  What did the defendant eat the day of the arrest? Certain foods can alter the chemical makeup of a person's body, thus influencing a B.A.C. reading.

4)  Did law enforcement maintain the breathalyzer properly?

If you're truly knowledgeable about DUI laws and procedures in your state, then perhaps you don't need a lawyer to represent you.  However, if you do hire a lawyer, you'll probably save a great deal of time and the whole process will simply be less stressful for you.
