Traffic offences aren't always clear cut

Most people think they are good drivers with a sensible attitude towards other road users, pedestrians and road safety in general. So it's surprising just how many people end up racking up 12 penalty points or more. Ordinary everyday people from all walks of life who have never been in trouble with the law before.

The most common offence is speeding. The use of cameras in the UK has grown steadily and the conviction rate has rocketed. Tough sanctions, like totting up twelve points or more in three years equalling a ban, mean that drivers have to sit up and take notice.

Most people, when confronted by a letter of an intention to prosecute for a traffic offence, assume there is nothing they can do. Which is not the case at all. Just like any other area of the law, people are entitled to make a defence of their position. And the law governing the use of speed cameras is extremely technical. If correct protocol and procedure have not been followed, then there is grounds for a defence.

Motoring solicitors know these laws and technicalities inside out. Far more people have a case than currently realise. They just end up taking the fine and the points on their licence unnecessarily. And those points start adding up, as people who drive for a living will testify. Most people depend on their car to make a living and for family life. A ban would be disastrous. It could even lead to losing a job or a marriage breakdown.

Motoring solicitors look at each case to see if the speeding offence is legitimate and whether the police followed the correct procedures to reach their verdict. Did they test their equipment? Were they using it on a straight stretch of road? If the prosecution is unwarranted or fails to follow standard protocol then there is grounds for appeal.
