How to go bankrupt in Kingston Upon Thames

Since the turn of the year everyone involved in giving debt advice has seen an increase in the number of calls coming into our offices. Credit Card bills are arriving after Christmas and people have found that they cannot put off the decision with what to do with their debt any longer. You may now be in the same situation.

I have had a number of calls from the London area, including in and around the Wandsworth, Sutton and Kingston areas. With that in mind I thought it would be an idea to set out a short article on how to go bankrupt in Kingston Upon Thames.

The process is carried out at the Kingston Upon Thames County Court which is situated on St James Road, Kingston. For those driving in the post code is KT1 2AD. There is a car park on the street which is ideal for the court. There is also a rail station within a few hundred yards of the court building.

The bankruptcy procedure in Kingston does not require any sort of booking. You may simply turn up at court on any day from Monday to Friday at 10am.

The court will want to know that the Petition and Statement of affairs has been completed and you will be asked to bring three copies of each. You will also need to bring a fee of £600 in cash to court which will be your court fee and Official Receiver's deposit. The court staff, will process your payment and check that your paperwork is in order.

The process is then that you must then need to wait until a Judge is free to see you. This can be very quick or it could take all morning. The problem is that no set appointment is made, you simply have to wait for a break in his list, when he can take you in.

He is likely to ask questions such as "have you taken advice" and "are you aware of the implications". If we are engaged to act for you, we attend the court and so explain to the Judge how we have assisted and that the decision to go bankrupt is the correct one for you.

Once the District Judge has made the Bankruptcy Order, you will be told to expect a call from the Official Receiver within 24 hours. The purpose of the call is to check that the paperwork has the correct contact details. The Official Receiver will write to you in the next week to ask you to complete some additional simple documents. He will also book a short telephone appointment when he will go through your statement with you.

You will be bankrupt for a maximum of a year, when you will then be automatically discharged and be free to get on with your life.
