You can avoid a lawsuit for credit card debts

Can you be sued for credit card debts? So many individuals have debts to repay and some accrue so much debt that they have to file bankruptcy as an extreme measure. A lot of you who stall paying debts for a long time may face lawsuits from creditors. Creditors want their money back and they would go to extents to get that money out of your pockets. If that means taking you to court, they will. However, not all creditors do that. Some co-operate and agree to an out-of-court settlement.

Facing a lawsuit for debts you owe:

If you have a debt on which you have been delinquent for more than 60 days your creditor may file a lawsuit. Creditors usually want to avoid the hassles of going to court to get the money out of you. They are more interested in the money than punishing you for not paying it. They have their own way, but if you make it difficult for them they may have no other way but to file one.

If you are at an age where you are likely to be employed and have not yet made your payments, your creditor may sue you. However, if you have a co signor on the loan, your creditor would rather pursue the co signor to pay off the loan rather than take you to court. You may try to convince your creditor to come to a settlement where you would pay off as much as you can afford. Many credit companies agree to this offer.

Tips to avoid being sued for credit card debts:

1. The best way to avoid a lawsuit is to make payments on time and to pay of the whole debt as agreed upon. A lot of you cannot follow this routine. So the next best thing to do when you realize that you are having a difficult time paying off your debt, try and talk to your creditor and explain to them your situation. It may be easier to ignore a debt and wait for it to drop off your records, but by the time it does drop off; it will have done you a lot of damage. Moreover, these debts do not go away easily, you always get calls from different debt collectors and it can be really troubling.

2. Don’t fall prey into buying every credit card that comes your way. Keep your expenditure under control so that you don’t have difficulty paying back your debts.

3. When you are already in to a bad situation where you owe a lot of money, don’t try to run away. You may think this to be an easy solution but your credit card company will trace you down or simply file a lawsuit against you. Try and figure out a plan to pay off your debts. Talk to your creditor and ask them for loan modification.

You must remember that a credit company is only interested in the money, so if you seek their help, they might as well help you for their money in return. They might even reduce your debt, reduce the rate of interest or extend the term of the loan or any other help that might be possible for them.
