GMAC not honoring legal aggrement

Hi David. I refinanced the mortgage on my Hawaii home in February 2007 with SBMC through LEI in California.  It was subsequently bought by GMAC.  The mortgage contained a soft-prepay, whereby there was NO prepayment penalty if I eventually sold in an arms-length transaction (the buyer was not a relative or business associate).  I even have a signed addendum to that effect as part of my closing documents package.  I am now selling my home in an arms-length deal to a couple in New York, and GMAC is stating that they do not feel they have to honor the no-prepayment addendumand want a $19K pre-pay penalty tacked on.  I and my title company have made over 30 calls to GMAC over the past two months to clear this up, but all we seem to get is incompetance, stone-walling and buck-passing.  I have contacted a real estate attorney who insists that GMAC has no legal leg to stand on in refusing to honor by pre-payment addendum and would be subject to paying triple damages and my attorney fees should I bring this matter to court.  What is your recommendation for my next step? I have a rental property that i payed off 2nd off 8 mos ago as a short settlement. My first is 159 k that i owe and property only worth 100k. I have it rented at 750.00 a month and paying 900.00 mortgage .i've got 2-3 more years on interest only and am trying to get loan modification to lower my monthly payments..any other advice? thx

In debt and mortgage trouble

We are feeling like the economy is in a terrible down spin and has no sign of stopping but gaining speed, the resent economic jump start payments that the government sent out doesn't seem to be making much difference at all, most likely it's because we all are so strapped already now and so much damage has already occured to the economy.  One of the things we are terrified of and are seeing happen first-hand to a couple of our friends is that they are finding it hard to cope financially.  The fuel for them to work and the many other expenses, along with credit card debt and investments that have gone terribly bad has left them with the prospect of loosing their homes.  We have one family friend that has just given up, they have notified the bank Chase Mortgage that they needed help, they notified them several months ago, Chase has offered no help or anytype of solution to the nearly 10% interest rate they are paying.  This family can't make the payments at this time now and asked for a lower interest rate or to defer 3 months so they can get on their feet, but still no answer from Chase.  So the family has decided to not make any futher payments and to go ahead and pay off their credit card bills and keep medical and daily expenses paid.  They have resolved that if Chase doesn't help they are going to loose their home, the family friends thinking is that if they can get their credit card bills paid off then when the time comes to foreclose they will  have no credit card debt or very little and everything else will be either paid off or up to date and hopefully they will have enough aval. credit and money in their savings account to find some place to rent until they can get back on their feet.  Keep in mind they have two school aged kits and a elderly in-law that lives with them and requires health needs, but their income is too much that they can't get any type of assistance.  what is some suggestions?
