Legal Eagle Seth Lesser Defends Privacy Online

Seth Lesser was lead counsel in Supnick v. Amazon.com, Inc., No. C00-0221P (W.D.Wash.), a consumer fraud class action in which the plaintiff claimed that Alexa Internet, a subsidiary of Amazon.com, tracked the online movements of individuals who had used their service, and kept personal information in its database when it was supposed to do so anonymously.

Seth Lesser also played a prominent role in MDL-1352 (In re Doubleclick Inc.) where he was co lead representing Internet users against DoubleClick In this particular case, it was alleged that DoubleClick's placement of web cookies on computer hard drives of Internet users who accessed DoubleClick-affiliated web sites constituted violations of three federal laws: The Stored Communications Act, the Wiretap Statute and the Computer Fraud and Abuse Act. Although the court did not find Doubleclick liable under these federal laws, Doublclick would eventually enter into a settlement agreement with the plaintiffs.

Under the settlement's terms, DoubleClick was required to explain its privacy policy to internet surfers in "easy-to-read" language and conduct a public information campaign to educate netizens more about protecting their privacy. Doubleclick was also required to institute data purging and opt-in procedures among other requirements.

Seth Lesser is the author of  “Privacy Law in the Internet Era” published in the September 2002 issue of Internet Law & Business. He was also featured in the September 2001 issue of the ABA Journal discussing Internet privacy.
