Rules for Unemployment Insurance

Sometimes with all the options available getting to what you need can be quite a task Especially when it comes to finding out what benefits you are eligible for. In this article we will look at some of the most common types of employment insurance benefits and how you qualify. We will also look at types of behavior that can cause you not to be able to claim your full benefits.

Unemployment insurance exists to help the unemployed meet their financial obligations and purchase goods and services. Everyone who has accumulated enough wage credits in their current job is eligible for unemployment insurance. What you receive is calculated based on your earnings. Usually the last 4 or 5 wages quarters is looked at to help determine the amount.

To qualify for unemployment insurance benefits you must be able to work, willing to work, and actively seeking work. Your employer must approve your earnings. If there is a discrepancy in the amount you claim versus the amount the employer states you earned, it is their responsibility to prove it.

The amount of time you can claim unemployment insurance can vary according to the state you live in. There is the possibility of extended benefit as well. Sometimes, in times or in areas of high unemployment, the state and local government will allow for an extension of unemployment insurance benefit to be issued. However, if you were discharged from your previous position for misconduct or left though your own accord, you may have difficulty in qualifying.

Unemployment insurance is designed to keep people in their current lifestyles and protect the local economy. Just because you are out of work, does not automatically mean you will be eligible. You need to have enough wage credits and clear of misconduct. Finding out what you are entitled to can be complicated however, in the end it is worth it. another job.

The advantages to having unemployment insurance is to help unemployed workers meet their financial obligations and to help sustain local communities. If a larger portion of a workforce is laid off or fired small towns and communities suffer also. Not only does regular wages pay bills and mortgages they also purchase goods and services. When wages paid to the workforce suddenly stop the local economy can suffer. You are allowed to spend the money from unemployment insurance on what you choose. There are no rules forcing you to pay your essentials first. This helps some of the money to reach the local economy.

Unemployment insurance or compensation is calculated by your previous earnings. It is not based on your needs. Different states apply different formulas but your unemployment insurance will be in line with your previous income.

There are some disadvantages to unemployment insurance. Sometimes you have to make a judgment decision on accepting a new job. You can accept a new job for less money. As soon as you accept the new job your unemployment benefits stop. However, if you do not accept the new job you will be putting yourself at risk. Unemployment can only be claimed for a limited period of time. Depending on where you live it could be 6 months to a year. So as you can see you could be risking a future income.

What if they Know I have felonies on my record hire me for 2 weeks and promise me a management position, but then somebody from corporate emails the manager telling him to let me go because of my background even though he knew it when he hired me? denying my rights?

I worked for IBM in Somers, NY for 34 years and was part of a layoff on March 5, 2007 which included a bridge to retire package and 3 months pay. I did not file for unemployment until 10/21/08. I have not been able to find a job and was not sure if I could file for unemployment so I called NY unemployment and was told yes I could. Even though there is 19 months between the time I left IBM and the time I filed can I still yet unemployment. I was told I could request a back date claim so I faxed that request to the NY State dept. of Labor on 2/15/09 along with proof of salary in 2007 and pension which only covers my mortgage. What else can I do to optain some unemployment and is there a time frame on applying for unemployment once you lose your job. Please advise. I really need some help. Thanks.

This past month and a half, I have been looking into Social Security benefits and Unemployment Benefits. I have gone one time to the Social Security office in person and have been told by two worker ladies there that I could collect Social Security Benefits and Unemployment Benefits at the same time. I am still looking for work. I also called about 1 1/2 months ago and was told by Stephanie or Yolanda or Wanda. (I think her name was Stephanie or Wanda) at the MS Unemployment office that "yes," I could collect both at the same time. I called them again another time and spoke with the same lady and she again told me, "yes," that I could collect Social Security and Unemployment Compensation, still pursue employment, collecting both. Now, when I tried to call in for my weekly reporting in, they say that I have to call because things have been momentarily stopped (I hope not for good,) because I went ahead and chose to retire, thinking into what would be best for my future, and now I have to call in tomorrow. This is scary for me because I called in 3-5 times to be sure. Will I be okay collecting both? Thanks Anita Stelling

I am on unemployment in the North East, my father who is ill is in Florida. I need to go see him but doing so puts my unemployment in jeopardy because "you have to be actively seeking work and available for work every day" - if I am out of state then I am "technically not available" - Yet, as Kay stated, you have people who always find ways to beat the system. I am not trying to pull one over I just want to see my father and still apply for work. It's just the continuation of demise in the system. The disappearing middle class person.

I am old enough to apply for social security. Will that affect my unemployment compensation? I will wait to collect my pension, and I can wait for social security too. But I would like to know if I can collect both.

I got laid off from a full time job. I got unemployment for only two weeks then I got a temporary job for about two months, will they still , accept me for unemployment again since it was only a temporary job.

To: Kay Casper. You need to mind your own business. If you care about your friend then leave him alone. This is not the Leave it to Beaver Cleaver days. It's a jungle out there where people are losing their homes,cars,retirement savings, everything and even going homeless out there on the street. He worked hard prior to getting those unemployment benefits. Yes, what he is doing is wrong, but many people lose their jobs and they need to recover for loss income. His lazy days will come to an end when his benefits get exhausted. Stop being jealous cause he is enjoying life while you are busting your tail. He paid his dues already sweety, now it's your turn. I have been out of work for a year on unemployment and it's dam nice for the first time in 20 years to be home with your family especially on holidays when I could never get time off during those times. It's sad thing when I was leaving unemployment office watching a mother crying while holding a baby cause she was denied unemployment benefits because her ruthless boss lied in order to get her denied. Employers & Unemployment screw people over all the time. If your friend is collecting on both ends then I salute him to get as much out as the system as he possibly can.

Grammatical error: Sentence should read: Usuallythe last 4 or 5 wage quarters is looked at to help determine the amount. Corrected plural wages to singular wage. I believe wage is modifying quarters, therefore, the word should be singular.

i work for a company that sends me out of town, but i used to get pay hourly and now my company is paying me by salary but i'm not happy with that because i'm making way lest money that before and i'm working more hours, i'm thinking about quiting to look for a new job that won't seend me away from home because my wife is pregnet and she needs me at home but i don't know what to do because is going to be hard for me to find a job because of the unemployment in texas. in my condisions can i cualify for unemployment checks if i have problems finding a new job?

I have a friend whos husband has been collecting unemployment for 1.5 yrs!!! he is currently working under the table and filing for yet another extension. I am frustrated because he is not willing to take another job because he makes more money on unemployment and working under the table??? I love my friends but isn't this my tax dollar?? I am certain there are others doing the same. 1.5 yrs seems like a long time ti be on unemployment and to get another extension is frustrating. He has been on maybe two interviews since he filed for unemployment and stays at home all day (UGGH!). There are many hardworking people out there making less for their work while he sits at home taking in unemployment. Is there anything we can do to stop this?

My husband worked for a construction company in texas, he was laid off with others as well, he received his check from a payroll company. texas is denying his claim because he didnt call some number on his check within 24 hrs of being laid off and was told he worked for this payroll company and they leased employees - we ask the employer the day they were laid off if they needed a pink slip or did they need to call this number or do anything else they said no it had already been handled. we filed march 15 and just got the denial today May 1 is there a time frame in texas as to how long they can take to decide and can they do this to us and how do i fight it? thank you for any help!!
