Following discussion triggered by certain Roman Catholic priests' being charged with sexual abuse of minor, the author of this feature, C. Dyson, has dedicated special section on his website to cover priests and church employees background check issues meaning to encourage practical input from behalf of lawyers, law enforcement agencies, professional private investigators and public activists into identification of potential gaps in background screening requirements compliance program to be implemented by the parishes.
Background check is rather common pre-employment practice with regards to quite a number of responsible organization and government related jobs. Background check on an employee can be described as finding and reporting certain important details from person’s history of life though investigating his or her past, as well as gathering information of importance from their neighbors, former employees, friends, co-workers etc. The information contained in public records is an even more important source of information about a specific person capable of providing more details to consider whether the person can be allowed to work in a church or not. If there’s evidence of malpractice or activities to deal with law infringement, then such persons needs further screening before ultimate decision is made whether employing such a candidate wouldn’t harm both reputation of the church and the well-being of its members. Normally background check should be outsourced from companies specializing in screening of background histories, instead of just using another of online investigation systems available online, which can be used for preliminary screening only. Private investigators are responsible personally for the accuracy of the information they are hired to obtain, and that’s the difference. The ministries should take care so background check procedure would apply not only to the church workers who get paid for their job, including priests. Volunteers shouldn’t be missed to undergo background check either, since the fact they are not paid for performing certain duties in the church doesn’t mean no liability of church for legal damages caused by their actions. Church, similarly to any other entity or individual enjoys easy access to number of public records that have been made readily available upon request, like sexual offender lists and registries etc.. So, it is the responsibility of the church to exercise due diligence and act wisely to possibly minimize the chances of malpractice among new employees. Church bus drivers belong to another category of church workers that should submit to background check with emphasis being put on checking them against DUI and DMV police files. To avoid such issues it is always better to find the background details by background check rather than facing them and finding after the incident since prevention is always better than cure. Financial malfeasance in the past should be taken into account only with regards to someone the church intends to hire for responsibilities having to do with church finances, raising donations etc. In some instances church may ask that applicants pay for background check they have agreed to undergo from their own budget, whilst argument continues between state and church over the costs, scope, and sources of financing.
