If you are the type of person that has no family, or unless you just don't care, the state in which you had residency will just might lay claim to all of your estate. If you do not have a spouse or children, and your parents are deceased, without a will, you are basically making a donation to the state. If you die without will and you are married, don't think that your wife will just arbitrarily receive everything you owned. Most states will allow the spouse to have everything, but there are a couple of states that won't and the laws are all different and have different stipulations. Without having a Will some states will only allow for the spouse to get from a third up to a half, with the remainder to be divided amongst any children. If there are no children, and no will, the spouse may get half and the state may get the other half. Of course every situation is different, but if you love you spouse and your family, get a will made up as soon as possible. You aren't getting any younger as each day goes by, and there is absolutely no reason that you would want the state to have anything that you worked for your whole life. Another thing you'll want to focus on while you're taking care of your Last Will and Testament project, is to make sure you are square with the I.R.S. before your death. If you had a considerable amount of net worth before you die, and had an outstanding tax debt or tax issue that kept you from paying, the I.R.S. will not only finalize anything and get what they decide you owe, but the process can put a freeze on all of your assets until the I.R.S. gets their share. Sometimes this takes literally months, and your immediate family may suffer greatly while this gets handled. So unless you have absolutely no family or friends, and just don't care what happens to all of your worldly assets after you die, then the sooner you get a will written, the better.
