Expert Witness Testimony for Eye Litigation

An effective ophthalmology expert may be a highly valued part of the litigation process for a variety of eye-related issues.  Ophthalmology experts are often called on to analyze the merits of a case, determine whether or not the standard of medical care has been met, assess the visual status of an injured party, and provide reasonable judgment concerning visual prognosis.

The first phase of an eye expert is determined by the nature of the assignment.  The scope of retention and the needs of the case are communicated between the expert and the attorney.  During the process of litigation it is important for the expert to be aware of all necessary facts and information that may influence a professional opinion.  All pertinent records from treating opticians, optometrists, and ophthalmologists are important to review.   It is essential for the ophthalmology expert to objectively review and analyze all relevant records on an assigned case.  A clear and unbiased presentation is needed for the eye expert to be informative and persuasive.

It is important for ophthalmology experts to understand that an objective presentation is needed for them to come across as a convincing advocate of their opinion.  Opinions that are based on misinformation or rely on invalid facts are easily exposed and dismissed.  Opinions not supported by solid facts do not provide meaningful assistance to litigation and can undermine the case as well as the reputation of the expert.

Preparation is an essential component of litigation.  An effective ophthalmology expert properly prepares reports that outline his opinion and the reasons for his conclusions.  Comprehensive reports and close familiarity with the case are needed for experts to excel in their testimony at deposition and during trial, both on direct and cross-examination.  Diligent preparation is the prerequisite the ophthalmology expert needs for confidence and effective testimony.

The ophthalmology expert who follows the guidelines promoted in this article, and who is able to communicate in language that is understood by juries and judges, are sought-after as the most credible of all expert witnesses.

Dear Sirs, I suffered an eye injury as a result of being given the wrong contacts on three different occasions. The lense suctioned my eye each time over a period of two years. On the third occasion the Oasys lense suctioned and damaged my left eye. It took 45 minutes to get the lense out, by then I was panicking. Now the optician is unwilling to take responsibility for the eye damage. In addition, the lense itself is Oasys, which I wear Accuvue 2's. For some reason I kept getting Oasys. Oasys lense's rubber is heavy, which is how it suctioned. I have extreme dry eye, and astigmatism, and the lense suctioned my eye. Now I have floaters and noticeable damage to the outer part of my eye, which looks like a cateract, which has never been the case. I am in need of an expert witness in order that I may pursue my case further. Thanks
