Foreclosure Scammers...Upfront Fees and False Guarantees

In these tough economic times, many homeowners having difficulty making their monthly mortgage payments are being targeted by scammers who charge large upfront fees and falsely guarantee to rescue a home from foreclosure. Foreclosure-avoidance scams are rampant these days, and while the Federal Trade Commission is taking legal action against some of the worst companies and re-examining its rules to help consumers avoid being victimized, the first line of defense starts with the individual.

Here are some tips to protect you from Foreclosure Scams:

  • DO NOT make your mortgage payments to someone other than the lender.
  • DO NOT pay upfront fees for help or information.
  • DO NOT sign any documents without reading them first or sign any agreement with blank lines or spaces.
  • DO NOT sign a home-sale contract where you are not released from your existing mortgage.
  • DO NOT sign a quit claim deed without being specifically instructed by your attorney or representative to do so.
  • DO NOT agree to any deal that allows you to rent the property and then buy it back at a later date.
  • DO NOT accept an offer from somebody who wants to make good on your missed payments and take the house off your hands in exchange for documents that assign them the surplus from the foreclosure sale.

These scams are so new, and the laws are so vague regarding them, that law enforcement has so far been reluctant to intervene. Even if the con artists were prosecuted, it would probably not be enough to save the home that was being foreclosed on in the first place.
