Ignition Interlock -- a DUI Prevention Tool With Questionable Popularity

There are a variety of different methods that states use to punish convicted DUI offenders while preventing DUI recidivism -- that is, getting drunk and driving again. Commonly, after the first offense, the driver's license is suspended from the onset, with stiff fines and possibly some community service landing the offender on trash detail off of I-90 in a day-glow monkey suit.

Commonly, a first-time offender may still find a harsh penalty. They can definitely find themselves with a steep ticket and an appearance at the municipal court house. Or, in some states, jail time may be a part of the punishment depending on what's current with the state's law books. However, when you are talking about repeat offenders, the penalties naturally get more rugged.

Some states implement a relatively new tool for a DUI offender that is called the ignition interlock system. This is basically a disabling system that can only allow a car's ignition to engage when the car's owner blows into an alcohol reading device attached and clears with a sober reading.

The interlock system has this blower device that extends from the car's dashboard. When given a good reading the electrical system activates and unlocks the ignition system allowing the car to be started. However, when the car is running the tester has to be blown into again every few minutes or so. This is considered the "rolling and running" retest, which eliminates the chance of having a sober friend unlocking it for them, or even worse, cracking open a brewski after given the system's go ahead.

One of the biggest advocates is the group MADD (mothers against drunk driving). However there has been some obstacles and resistance to fully implementing this device.

Interlock Limitations

The interlock device is, on its face, quite clever and novel of an invention. It's so attractive that the largest anti-drunk driving non-profit group MADD is touting its mandatory use for all states. However, it's unfortunate that there is little statistical evidence that shows DUI offenders repeating offenses less with states that use this.

For one, there are still loopholes despite the "rolling and running" retest system. The intoxicated person can simply take another car -- a friend's, a rental or otherwise. The system of retesting during the drive has shown, in some results, higher incidents of crashes. And, after nearly a decade of many states using this system, no good evidence has shown otherwise. Until the root of alcoholism is staved off, the DUI courts may not find this popular until it shows better results.

Perhaps Mr. Gib should do a bit more research on the decreased recidivism rates directly resulting from using Ignition Interlock Devices. The statistics are documented. The percentage of people going \"around\" the device is acutally quite low- especially when compared to the the number of lives saved by the thousands operating the device correctly.

First of all, let me compliment you on your document that has taken on a lot seemingly interlocking issues and points of view and have clearly presented an argument that when broken down as you have only require simple logic and common sense to grasp the concepts and determine that they system is unfair.

In my case, I received my most recent DUI on March 30, of 2006. I still had another DUI conviction on my record from 6 years & seven months so what am I guilty of. Another 5 months and this DUI would not have been bundle into the first arrest. Yet I am treated as if I was arrested for both crimes within the same year and this is what I believe what you are referring to in your point of fairness.

In addition, I do agree with your assessment of the Police and how they attend training, paid for by the taxpayers, that actually teach the officers to word their reports that are designed to protect the police officers regardless of weather proper procedure was followed or in many cases brutality is used but if not for the unexpected camera-phone video, thee instances never get reported. If fact quite often they add up to more charges such as assault or resisting arrest for the person taken into custody.

This is a classic case of the fox watching the hen house. Since (purposely) no procedures are in place to insure accuracy of incident, the cops will always distort the events as they happened sometimes to leading to false charges and even perjury.

I need help with another issue, My DUI took place in March of 2006. I have met or exceeded every criteria requirement required by the State of Michigan (Macomb County) I have done the following:
· Attended and completed full rehab and upon leaving I received a positive referral and discharge papers.
· I attended 90 AA meetings in 90 days. Continued to actively attend AA meetings although the frequency had dropped several times per week during from May 2006 through the middle of 2007. Currently attend AA meetings approximately once per month.
· I secured a sponsor
· I have been meeting with a alcohol physiatrist every two weeks for the past 2 1/2 years.
· I have complied with all court ordered requirements as terms of my probation.
· Early discharge from probation
· Successfully completed Alcohol Education Series through Eastwood Clinic
· During this down time I completed and received a MBA degree from Ferris State University.
· Have not had a drink since March 2006.

Is there any possible way to get a full license re-instated without having to install an interlock system in my vehicle? I believe that under Michigan law, the need for an interlock system is not mandatory yet is the judgment call of the official hearing my request. Does anyone have information related to my cause? Thanks
