In order for a medical malpractice claim to be deemed legally valid in a court of law, certain criteria must be met.  The health care professional or doctor being charged with medical malpractice must have owed the patient a legal duty.  In the course of the health care professional’s treatment of the patient, that duty was broken, and the professional did not abide by the required standards, procedures, and treatments that most medical professionals hold dear.  Because of the medical professional’s breach of duty, an injury was inflicted upon the patient.  This injury than causes severe damages to the patient.  These damages can be monetary, in which further costs were incurred to undo or fix the health care professionals mistakes, physical, in which the patient received a injury that caused him or her physical harm that could have been avoided if the health care professional had followed proper procedure, or emotional, in which the patients mental well being is damaged and his or her mental is altered because of the health care professionals subpar medical treatment.

Unfortunately, in today’s world, medical malpractice is more common than not.  Several studies have shown that most Americans will endure some sort of improper medical in the course of their lives.  As health care costs continue to rise, the quality of care becomes more and more important.  In these times, it is imperative that patients be on the look out for Medical malpractice to ensure the health and well being for themselves and their families.
