What to Know About Active Arrest Warrants

When a crime has been filed in the police report and a person has been identified as a possible suspect, the investigator handling the case will have to make a case report where important details like witnesses’ accounts, personal information about the suspect, the account of the circumstances surrounding the crime and other pertinent details regarding the charges are included in the report. The officer has to present the report to the prosecutor for review and if the case has enough evidence for trial, the prosecutor will then have to present it to the judge for another evaluation and if the case has enough merits, the judge has the power to issue an arrest warrant for the person in question to be brought in and face the charges in the court. An arrest warrant becomes an active arrest warrant if the police department authorized to carry out the arrest started to enforce the said warrant of arrest.

Arrest warrants are public documents and are accessible for public viewing and some department would even furnish a copy if requested. As long as the request is able to provide a legal basis and a reasonable motive, record for existing arrest warrant against an individual can be easily obtained through the court office or from the internet. By having the knowledge about these particular things, it helps people to be prepared against it and be ready to face the said warrants with the help of an experienced attorney. This can also help law enforcement agencies to implement the said warrants if a person doing a background check happens to stumble upon an active warrant and personally know the person in question. He has the option of telling the police that the said person with active warrant is in the vicinity.

Identity fraud is also thriving in today’s time and a lot of people are issued with arrest warrants even if they are not the one who committed the said offense being charged to them. Knowing that a person has an arrest warrant against him even if he has no idea about the charges leveled against him, he can inform the police right away that he is not the person stated in the arrest warrant even before the police department can go after him and serve him the warrant. This way, people can avoid being put in a compromising situation.
