In 1947, the supreme court declared,'The First change has erected a wall between church and state. That wall must be kept high and impregnable. We could not approve the slightest breach.' actually, the'separation of church and state' phrase which they invoked is not found in any of our official government documents. It was taken from letters between President Thomas Jefferson and the Baptist association of Danbury, Conn.
On Oct. Seven, 1801, the Danbury Baptists wrote the new president a letter in which they expressed concern over the first change and its guarantee of the'free exercise' of faith. This suggested to them the right of religious expression was government-given ( thus alienable ) rather than God-given ( hence inalienable ), and therefore the govt might sometime attempt to regulate non secular expression. They strenuously objected to this possibility unless someone's spiritual practice forced him to'work ill to his neighbor.'
by the Constitution.
-Kentucky Resolution, 1798
In matters of faith, I have considered that its free exercise is placed by the Constitution independent of the powers of the general [federal] government.
I consider the govt of the U. S. as interdicted [prohibited] by the Constitution from intermeddling with religious institutionsor exercises.
-Letter to Samuel Millar, 1808
Having witnessed the tendency of govt to encroach upon the free exercise of faith, President Jefferson had written to Noah Webster in 1790, saying he had zero intention of allowing the government to limit, restrict, control or interfere with public non secular practices. He thought, along with the other founders, that the first change had been passed only to prevent the Fed. In his answer to the Danbury Baptists on Jan. One, 1802, he guaranteed them that the free exercise of faith would never be interfered with by the central government.
Adhering to this expression of the supreme will of the state in behalf of the rights of conscience, I shall see with sincere satisfaction the progress of those sentiments which have a tendency to restore to man all his natural rights, convinced he doesn't have any natural right in opposition to his social duties.
The president's reference to'natural rights' reaffirmed his faith that non secular freedoms were inalienable rights. 'Natural rights' included'that that the Books of the Law and the Gospel do contain'-that is, what God Himself had sure to man in the Scriptures.
When the president warranted the Baptists that by following their'natural rights' they would violate no social duty, he was attesting to them that the free exercise of faith was their inalienable, God-given right and therefore was protected from Fed. regulation or interference.
Having witnessed the tendency of government to encroach upon the free exercise of religion, President Jefferson had written to Noah Webster in 1790, stating he had no intention of allowing the government to limit, restrict, regulate or interfere with public religious practices. He believed, along with the other founders, that the First Amendment had been enacted only to prevent the federal establishment of a national denomination. In his reply to the Danbury Baptists on Jan. 1, 1802, he assured them that the free exercise of religion would never be interfered with by the federal government.
