Who actually creates a Maryland Will or Maryland Last Will and Testament?

Posted: Dec 02, 2010 |

There has always been confusion as to who actually creates a Maryland Will or Maryland Last Will and Testament. The reason why people have been so confused is because many individuals claiming that they are experts in Will preparation have been creating Maryland Wills and Trusts. However, these individuals do not possess the adequate legal study or experience to prepare effective Maryland Last Will and Testament. The individuals that are best suited to prepare an effective Maryland Will with the latest estate planning provisions are Maryland Attorney. A Maryland Attorney is trained and educated in the field of estate planning and has the specific knowledge of Maryland State laws that directly affect estates. Because of their requisite training and experience you will rest assured that they will prepare your Maryland Will that not only takes into consideration all of your needs and desire but also the legal document is created with the latest and most advanced estate planning provisions.

Why would you even create a Maryland Will anyway you ask? Well this document is extremely important and is very useful upon your passing. Lets say that you have acquired and have amassed a pretty good sized estate during your lifetime. You have a home, cars, as well as some other personal effects that are very dear to you for example jewelry, coin collections, etc… Also imagine that your wife has passed on before you and you have three children. Upon your passing the courts will really have no way of determining which of your children will receive which of your assets. Say one of your sons really wants your car but your other son also wants the same car. Depending on how much they really desire to have your vehicle this will eventually lead to litigation and to court. The issue will in particular go to Probate court where a judge will adjudicate the case in order to determine from the facts and circumstances of the cases to whom you desired to leave which of your assets. At the same time your children will also have to hire their own probate attorneys in order to help them get what they believe they deserve. The issue with this is that the attorneys will charge very high hourly rates and fees when your case has to go to litigation and court. This all could have been avoided if you had retained the services of a Maryland Attorney to prepare your Last Will and Testament. When you retain the services of the Maryland Lawyer he or she will listen to you very carefully and create your Will that not only specifically outlines what you desire to leave to whom but also ensures that your legal document follows and incorporates the latest in estate planning provisions. By simply doing this you will have avoided much expense in the future and there really would be no need for your children to have to go to court in order to defend what they believe they are entitled to.
