What is the worst situation for a person that is trying to manage debt? Undoubtedly when all what you do did not work out and now you deal with your creditors in court, there is no debt management program that can assure you success and getting you debt free, you need to accept that sometimes it is too late and that you crossed line where some debt relief is possible.

However, if you need to face such situation, it is important to understand the whole process in order to know if you have any options, this way you know exactly recommendable steps to follow that are suitable for your needs:

So, we have a creditor taking you to court and winning because of no valid defense in your side, then with a judgement against you the creditor goes after your assets, but is not that easy, a creditor no necessarily collects or get what they want, even they may not get a single penny of you, it is all about the State this is going on.

Different States and different legislation:

Each State is different, while the creditor can go legally after your assets, there are items - again, depending on the State - that cannot be touched, another important point is that the creditor needs to discover your assets in order to know essentially what they can take, how about if you do not have income or property? if it has been proven that you do not have any kind of income or property, then the court order could be considered almost just a piece of paper.
