Boat Accidents

Common factors involved in boat accidents are operating a boat while under the influence of alcohol and/or drugs, severe weather conditions such as strong winds or heavy rain, and inexperienced boaters encountering dangerous or unfamiliar conditions.

The Law Regarding Boat Accidents

By law boating accidents are not limited to collisions, but may occur whenever someone is injured, disappears or is killed while boating. The United States Coast Guard (USCG) defines a boat accident as one of three scenarios:

  • A boat causes damage or sustains damage
  • A boat passenger disappears and injury or death is suspected
  • A boat passenger is seriously injured or dies

Boating and Negligent Behavior

A person acting negligently while operating a boat can be held at fault and liable for property damage, medical expenses and other expenses incurred as a result of the boat accident. Negligence implies the operator failed to adhere to safety rules and procedures. In addition, criminal charges can be brought against the operator of the boat if the accident occurred while they were intoxicated or they operated their boat with gross negligence or recklessness without regard for the safety of others.

Reporting a Boat Accident

The operator of a boat involved in an accident must file an accident report for an accident that causes significant injury or property damage. If personal injury or death results from the boat accident the report must be filed within forty-eight hours. If only property damage was sustained, they are allowed ten days to file their report. Failure to file a boat accident report is a criminal offense.

Whether you are on a boat fishing or just relaxing in the sun, your safety depends, to some extent, on others following safety rules and precautions. If they fail to do so, it often leads to serious injury or wrongful death.
