Environmental Injury

As the number of industries and manufacturers grows in the U.S., so does the number of chemicals used in the manufacturing and industrial process. Unfortunately, many of those chemicals and by-products are dangerous, toxic substances that can cause not only environmental concerns, but also health concerns, when allowed to seep into our air, water, soil and buildings.

In the latest report from federal authorities, approximately 35,000 environmental incidents were recorded in just one year. These “incidents” are documented problems of careless behavior or known negligence when it comes to the use and disposal of toxic substances.

What is an Environmental Injury Lawsuit?

An environmental injury lawsuit, also known as a toxic tort, is a personal injury claim that an individual’s health, financial situation or other interest suffered damage caused exposure to a dangerous substance. The exposure must have occurred because of someone else’s mistake or wrongdoing.

Environmental injury cases can help victims receive financial compensation for their injury. This can be especially important for cases where the exposure has brought on a long-term or even terminal illness.

A successful environmental injury claim could gain monetary damages to help pay for:

  • Medical expenses, including chemotherapy, radiation, prescription medicines and surgeries
  • Loss of past, present and future income
  • Emotional, mental and physical pain and suffering
  • Job and other forms of rehabilitation
  • The expense of any chemical/waste cleanup necessary

Well-Known Toxins That Can Cause Environmental Injury

  • Asbestos. More than 1 million American workers face asbestos exposure on the job. Asbestos can cause lung cancer and other serious lung diseases.
  • Lead. Lead poses extreme health risks, especially to children. It can be found in household products, gasoline, paint, plumbing and pottery. Excessive levels of lead poisoning can lead to seizures and comas.
  • Mold. Ongoing exposure to certain types of mold can cause serious breathing issues, particularly for children and the elderly.
  • Arsenic groundwater contamination. Arsenic is a highly toxic substance found in drinking water. The chemical is still used in products like pressure-treated wood. Prolonged exposure to arsenic can cause cancer.
  • Benzene. Benzene is used in the manufacturing process for a wide range of things, from nylon, dyes and detergents to rubber and plastics.
