You can file a bodily injury claim when through negligence or by the fault of another you are injured. For example an injury that occurred in your workplace or even a fall in due to a slippy floor. You will be dealing with the insurance company of the person or company responsible for your injury. If the person responsible did not have liability cover then you could claim on your own insurance.
Here are some basic tips to help you win your claim.
In effect your claim starts when you visit a doctor or emergency room after the incident. Visit a doctor as soon after the incident as possible.
Make sure you tell the doctor all of your symptoms. The doctor will file a report so it is vital that all your symptoms are recorded.
Be very careful what you say. Many doctors will ask open questions such as “how are you feeling” or even “what do you have planned for the holiday”. These may be noted on your initial report. The insurance adjuster may use “chit chat” against you.
Ask the doctor for a work release even if at the time you may feel you don’t need one. Injuries such as whiplash may not develop for a couple of days. If you feel fine and are happy to return to work then do so.
Suggest to the doctor that you need a referral. The emergency doctor will only initially see you because of the accident. If you don’t do get a referral visit your primary practitioner and ask for a referral.
It is very important that you visit the referral doctor as soon as possible. Again tell him all the symptoms you have.
Make sure you keep any future doctor appointments and stick to any prescribed treatments. Not doing so will damage your chances of winning your claim.
