I’ve Slipped! I’ve Fallen!

Let’s say it together. “Help, I’ve fallen and I can’t get up!”® It became a very popular catch phrase in the early 1990s and folks still use it jokingly. Almost like the boy who cried wolf. You say it so much, that when you really mean it, no one will listen!

But, for lots of people every year, that phrase isn’t crying wolf at all. Thousands of people slip and injure themselves, sometimes seriously, and as the result of someone else’s negligence. That’s where the legal term “slip and fall” comes from. It refers to the personal injury you sustain from slipping or tripping and falling on someone else’s property. You’ve probably read news reports about people slipping on an unmarked wet spot in a grocery store and filing a claim. There are other situations, as well, that fall (ahem!) into this category:

· Uneven walking surface

· Holes in the floor (seen and unseen)

· Poor lighting

· Insufficient stair handrails

· Uneven floor mats

· Uneven ground such as potholes, cracks in sidewalk

These situations can happen in just about any business environment, as well. Grocery stores, restaurants, office buildings, shopping malls, private residences. Even outdoors in parking lots and on sidewalks. The injuries you can sustain from a slip and fall accident are just as varied as the locations.

· Minor scrapes and bruises

· Broken bones

· Dislocated shoulder or collarbone

· Head trauma

· Brain injuries

· Spinal cord injuries

Suddenly, “Help, I’ve fallen and I can’t get up!”® has taken on a serious meaning once again. But what happens next? If you fall and hurt yourself on the sidewalk in front a mall store, is it that store’s responsibility to help you?

The answer is a resounding maybe. It could be the tenant, the property owner or a combination. Plus, their insurance companies will need to be involved. Circumstances dictate everything where the law is concerned. Your best bet is to contact a very knowledgeable slip and fall attorney and give them all the details. They will help you in determining who the responsible party is and how to determine your financial needs.
