Nursing Home Abuse and Neglect

Over thirty-five million people are over the age of 65 in this country. At some point in the future, many of these senior citizens will require assisted living residences or nursing home care. Many facilities available in the United States offer quality care provided by caring, professional and supportive staffs. However, some older adults find themselves in less than ideal conditions, vulnerable to neglect and abuse by uncaring staff members that at some levels rises to criminal assaults.

Under the law, nursing home residents are guaranteed specific rights. They have the right to receive humane, dignified care at all times. They have the right to be free from physical, emotional and verbal abuse, and the right to be treated with respect. These are just some of the basic rights afforded a resident of a nursing home or assisted living facility. It is not always obvious to the casual observer if neglect and abuse is happening. Usually the nursing home resident is unable or reluctant to complain to family and friends because of fear of retaliation or the inability to articulate the problem.

Nursing Home Neglect and Abuse Signs

  • Personal hygiene needs are not being met
  • Ongoing infections
  • Unreasonable restraint practices
  • Heavily medicated behavior
  • Unexplained sores or wounds
  • Claims of being hit or mistreated
  • Resident acts extremely withdrawn or depressed and anxious

The consequences of nursing home neglect and abuse are serious and often result in injuries, malnutrition, dehydration and death. Almost one million older adults are the victims of nursing home neglect and abuse in this country every year. One can only guess at the figure that goes unnoticed and unreported.

When nursing home neglect and abuse is alleged, however, there are many complex legal issues involved. There are the issues of premises liability, medical malpractice, negligent security and wrongful death in the extreme case. An attorney who is experienced in nursing home neglect and abuse will guide you in your efforts to secure the legal rights of the victim in these cases that are so disturbing to all of us.
