Personal Injury Claims – How exactly do they Work?

Generally, if you've suffered an injury which was not your fault, then you will consider filing a personal injury claim. Personal injury claims are claims for compensation when you've suffered injuries – usually in a motor accident – due to the negligence of someone else. Personal injury claim is big business in countries that have a well developed legal system. Thus, if you live in the US or UK, personal injury claims are quite common, and lawyers are always looking out for individuals who would like to file a claim. It is quite likely, that when you have an accident and start looking for personal injury solicitors – you'll be inundated with offers from firms and lawyers telling you how great they are at solving your problems. There's no need to get overwhelmed, they're just doing their job.

When you meet with an accident on the road – let's say you were hit by a speeding vehicle that cut into your lane – the driver of the other vehicle automatically becomes responsible for paying up for the repairs to your car and also any medical expenses that arise in case you're injured. These expenses are paid out of the other party's insurance. (Usually all cars are covered to some extent by insurance – it's mandatory for driving a vehicle) Now if the damages are within this insured amount then it is usually quite simple – the insurance company pays up front. But if there's been a lot of damage and the insurance amount isn't enough to cover it, then you will need to find a lawyer who can file a personal injury claim and claim the amount from the insurance company.

Usually, the damages covered by insurance will be repairs to the car and some medical bills (if you had to get a general check-up from a doctor). However, for expenses such as a new car, medical expenses like surgery, hospitalization, and also indirect expenses arising out of taking time off work (losing wages), making changes to your lifestyle, you will need to file a personal injury claim. To this amount, your lawyer will also add a monetary compensation for the pain and suffering and inconvenience you had to go through. He will decide this amount taking into consideration the facts of the case, and also the chances you have of getting your claim fulfilled.

When your lawyer has come up with the total amount of compensation, he will approach the other party's insurance company (their lawyer) and both will negotiate and reach a compensation amount that is mutually acceptable. However, sometimes this doesn't happen – that is when the claim goes to court, where it is settled by law. This is the part where you need a really good attorney, who can prove that the driver of the other vehicle acted in an unlawful manner, and caused you injury and thus is liable to pay. If he wins the claim, you get the compensation you desire.
