The phenomenon known as seat back failure is a life-threatening defect that causes numerous fatal injuries and deaths each year. Seat back failure occurs when the front seats of a vehicle fail to stay upright in a rear-end accident. The force of a rear-end accident pushes the vehicle forward and thrusts the passengers backwards. When this happens, car seats are designed to keep the passengers upright but sometimes the mechanism holding up the back of seat can break, causing the seat to collapse and the passengers to fall back violently. If the seatback is defectively flimsy, accident records show that this can happen even in minor collisions, at speeds as low as 25 miles per hour. Furthermore, a collapsed seat can kill or injure back seat passenger.
Defective seat backs pose a great threat to the passenger of the defective seat. Passengers can be thrown away from seatbelts and airbags causing them to suffer serious head, spine and neck injuries. Even at low speeds, a defective seatback is dangerous. Every major auto manufacturer in the USA has been accused in court of law of manufacturing defective seat backs. Studies show that the auto industry has been well aware of the defective seat backs as early as 1960s.
If you or your loved ones have been a victim of a defective seat back which resulted in a death or a serious injury, you have the right to hold the manufacturer legally liable. You may have a products liability action against the manufacturer of the vehicle. An experienced seat back failure attorney can help you recover compensation.
