Surgical errors or surgical malpractice, cause a very high number of deaths in the United States each year. A surgical error refers to the failure of a surgeon to provide an adequate standard of treatment and care for their patients, which then results in injury or death.
One half of all medical malpractice lawsuits filed in this country each year involve surgeons. These cases involve pre-operative procedures, actual surgical procedures and post-surgery recovery. There are inherent risks with all surgical procedures, but surgery that is found to be below the accepted standard of care and treatment is not risk, it is surgical malpractice.
Surgical errors occur when the generally accepted standard of care is not met. This means for instance, the wrong surgical procedure was performed, surgery is performed on the wrong limb, medical instruments are left inside the surgical site, or the failure to recognize the procedure is not going as planned. Errors also occur in the administration of anesthesia and management of post-surgical infections.
Surgical procedures most commonly involved in surgical malpractice allegations include:
- Cosmetic surgery
- LASIK eye surgery
- Gastric bypass surgery
- Back and orthopedic surgery
Patients and their family members are often unaware that a surgical error is responsible for their poor prognosis or unsuccessful surgery. The patient and family members should not have to suffer emotionally, physically and financially for the surgeon’s error.
Compensation in the case of a surgical error resulting in surgical malpractice can include damages for medical expenses, pain and suffering, loss of income, loss of future earning potential, and loss of quality of life. If the surgical error has resulted in a death, the family members, heirs, beneficiaries and dependents may also be eligible for compensation. It is in your best interests to protect your rights by consulting with an experienced surgical malpractice attorney if you suspect surgical malpractice.
