Workers’ compensation laws are designed to provide monetary compensation for those who are injured or disabled while at work. Most states require companies to provide workers’ compensation coverage. There are, however, important steps to take if you should be injured or disabled at work.
What are your responsibilities?
If you are injured on the job, there are certain things you should do in order to ensure you receive the compensation you are deserved. These include:
· Obtain medical treatment immediately.
· Be sure to inform any medical providers that the injury is work related, so this fact will be reflected on any paperwork
· Keep copies of any and all bills, as they will be covered by workers’ compensation
· Inform your employer or supervisor of your injuries suffered at work in writing within 30 days of suffering the injury
· Read the workers’ compensation section of your contract to familiarize yourself with any other responsibilities you may have
· Follow your doctor’s instructions to the letter
· Keep your employer informed of the name and address of your medical provider and the rate of your recovery
· Remind your doctor to send your medical information to your State Insurance Fund
· Consult an experienced workers’ compensation attorney
· Before you return to work, contact your agency
· Return to work as soon as possible after your recovery
Once an injury suffered at work is reported to the employer’s insurance agency, an adjustor is assigned to the case. The adjustor’s sole job is to attempt to limit any financial responsibility of the insurance company. The insurance company has someone working on its side and you should too. This is why it is important to consult an attorney.
Exceptions
Most personal injuries incurred at work are covered. However, there are exceptions to this. Some exceptions that would preclude your coverage include:
· Intoxication. If you are intoxicated or impaired due to alcohol or drug use, your injury will not be covered.
· Commission of a crime. If you are injured while in the commission of a crime, your injury will not be covered.
· Violating policy. If you are injured while violating a company policy, your injury will not be covered.
These exceptions may make it difficult for you to know whether or not you are entitled to receive workers’ compensation and this is another reason to consult an attorney. An attorney will go over your case and injury reports and assess whether or not you are entitled to receive workers’ compensation, will work to obtain the amount of compensation you deserve, and will advise you of the proper steps to take in order to ensure you receive such compensation.
