How FCRA protects the home buyer

There are many tools that the government uses to protect the consumers’ rights as far financial information and their usage is concerned. The Fair Credit Reporting Act (FCRA) is one such law that seeks to protect the usage of credit information by credit reporting companies. Companies such as Equifax, Experian or TransUnion are given licenses for credit reporting and creation of reports based on consumers’ credit worthiness. This is a federal law and any breach of this rule can lead to serious results for the companies involved. These companies have a number of responsibilities and have to adhere to certain standards of honest reporting. As these reports are used for credit evaluation by banks or other lending institutions, they need to be accurate and honest. This makes the work of the credit reporting company very critical as any information contained in these reports can make or break a deal of the consumer. Hence, this law acts as a strong watch dog to make sure that no financial information is misused by the company for any purposes.

As a home buyer, you are protected to a certain extent by the FCRA. If you have a good credit history, but have still got an adverse report from insurance or any such company, who has done a check on your credit, then you can approach the reporting company and demand a free report. If the report has errors, and you have enough proof to prove otherwise, that the report is either false or has been doctored with, you can proceed to take appropriate action against the company. This also entitles you to force the company to rectify the report and send the insurance company the corrected version, so that you have no trouble in taking the insurance or any such activity. You are also entitled to get a free report once every twelve months, so that you can keep a regular check on the facts and figures that are being reported.

There has been an amendment to this act and the new act is known as FACTA; or fair and accurate credit transactions act. This is a move aimed at strengthening the FCRA further so that no company tries to misuse the rights given to them.

Home buyers who have always led a disciplined and financially secure life can look forward to a hassle free procedure as far their credit checks are concerned, all because of the security to their information that FCRA and FACTA bring along. Such laws help protect the confidentiality of a person’s financial information, as any leakages to such reports can adversely affect the person or his business.
