How To Know The Renter Has Left

As a rental property owner it is vital for you to terminate the existing lease agreement to have a new tenant and a new lease. If you find that the tenant is not up to your anticipation then you can always remove him from your property but what to do when the occupant leaves without notifying you  or how would you know that your renter has finally left?

These are simple situation but can cause an owner a nightmare. What if the property that is leased to the tenant is no more in good form or what if the tenant left without paying the balance rental amount or there might be a case wherein the tenant has left some stuff behind? These are problem that have always haunted the landlord. Not all of them are lucky to have a good renter. Therefore if you happen to let out your property to a tenant who has good past record then it is always better to retain him.

Nevertheless let us consider the case when the tenant has left the property. It maybe he did it without notifying the landlord or perhaps he is asked to vacate. Whatever are the circumstances when you find that the tenant is not answering your call or is not showing up when called or not paid his rent for the last couple of months you can visit your rental property and check for by yourself to see if he is still there in your property or not.

You can investigate with the neighbors and see when he was last seen in the place or you can check the premises by entering it for making yourself sure. But you have to be very cautious when moving in because you can be subject to forcible entry. The explanation behind is when the property is leased out, unless it is in contrary to agreement from both the parties, the landlord has no right to enter the premises without the tenant’s permission. There in doing so he can be convicted also under trespassing act.

However the tenant has deserted the property or not as a landlord you can make out by taking a good look at the factors and present condition of the property. It is always sensible that even if you happen to have the spare key of the main lock then also it is better to enter by knocking first. Once inside you can look for his belongings if any. Check out if there is any furniture left. This way you can be sure of abandonment and you can change the main lock with a different one.

But before that it is also significant that you confirm other factors as well. Like if there is any application for change in address in the post office by the tenant or maybe he is in hospital or perhaps he is arrested for some case. This could be the reason that he is not in the premises. Whatever is the case it is very important to learn all the factors before termination of the lease deed.

Every state holds different opinion for abandonment. Like for example, removal of all the personal belongings from the premises with the intention of never returning back can be considered as abandonment under law in some states or non-payment of rent for the last two months or any statement made by the tenant for not occupying the property after a specific date.
