Purchase Panama Real Estate – You Won’t Regret it

Purchasing real estate in Panama can be a profitable, satisfying experience. The country is far more advanced than Costa Rica, but real estate prices (in general) are far lower. Foreigners have the same property rights as Panamanian citizens, and if you purchase your real estate through a corporation (very easy to set up) you will be exempt from property taxes for 20 years.

However, you need to be very careful when buying property through a real estate agent. Fraud is rampant throughout Panama, and little is being done to stop it. In 1999 the Real estate Technical Board (Junta Technica de Bienes Raices) of the Republic of Panama was formed. Supposedly this government agency has the power to consider complaints arising from any real estate transaction, and to impose any sanctions that are deemed necessary. This includes anything from a reprimand up to a revocation of an real estate agent’s license, so they can no longer sell property in Panama. This all looks good on paper, but in fact the Board has proven to be almost completely impotent in stopping real estate fraud in Panama.

Case in point: my first real estate property purchase in Panama was done through a company called Great Land Panama. The owner of the company, Khadine Smith, defrauded me out of thousands of dollars when she charged a 30% commission. She then turned around and stole $20,000 from the landowner, by not paying him the price that was in his contract.

I had to talk with five attorneys before I could even find one who knew how to file a formal complaint with the Real estate Board. The complaint was filed in May of ’08, after which I heard nothing for more than six months. Finally in Dec ’08 I was able to get in touch with a senior official on the Board. He informed me that this particular Panama real estate agent had four other complaints against her, involving millions of dollars. The Board had not yet investigated any of these complaints, but he assured me that they would “get around to it very soon.” Bottom line – she is still out there ripping off unsuspecting foreigners, and will probably continue doing so for the foreseeable future.

So what is one to do? It’s fairly simple; make sure that you either work directly with the landowner or with a foreigner who is already developing a project, with no intermediaries. I personally know several “gringos” in my area of the Azuero Peninsula who are working on various projects, and none of them used an agent for their real estate property purchase. Sr. Tuxbury,
Khadine is notorious for keeping the buyer and seller seperate so that they cannot share info ie... sales price, the price you are paying. A professional realtor will not try to hide the seller from the buyer. I recommend you demand to speak to the seller. She will create a song and dance why it is not possible and then you will know she is merely creating a price with a super commission included for her. This is her game. She may be making as much as the owner if not more. Greatland Panama is not licensed and Khadine's real estate license is suspended. I recommend looking for another realtor if it's not too late. Dear Sr. Stafford I can appreciate your loss, I know other people who have been victimized by the same Khadine Amarilis Smith representing Greatland Panama. Your comments about her are on the money. She is most definetly a bad person and I commend you for warning people against her and her business practices. However, Sr. Stafford I respectfully disagree with you about not using a "middleman". I'm not saying everyone needs one and every person undoubtedly has a right to seek and negotiate their own real estate deals but,not everyone has the time nor the capacity to come to my country to scout and negotiate property on their own. (A client definetly needs to be weary and do a proper background check on the license status of any realestate agent with the Junta Tecnica de Bienes Raices de Panama tel. 507-560-0600 before doing business.) Most people don't want the hassle nor have the time to find their own property. A competent realestate agent can do all of the leg work, make all of the contacts and perform legal and binding contracts. Another point is, a good realestate agent will also have a long list of properties and price ranges that are available for sale which will save the average person a lot of leg work, possibly months. It sounds like you are really trying to help and again I commend you but, please, if 100 people were to ask you for your help to translate negotiations are you really going to take your own time to drive hours and hours and walk properties for the benefit of someone you may not know, for free? Are you going to recommend where to start looking for properties too? Are you going to hold their hands and offer advice based on your own experience the way a good realtor should? How long will that last? Three or four trips max? I think your intentions are good but, you are better off leaving it to a professional who is more capable because they do it everyday for their livleyhood and most likely knows the land better than you do. Basically, you have condemned all realestate agents for the actions of one bad agent. This hardly seems fair to the hard working realestate agents who are trying to make an honest living. Your method may work but, not for everyone. Again, I sympathize with you for your loss but, business is tough and you've only made it tougher for the honest hard working agents trying to do business here in Panama.
