The Anatomy of a Standard Rental Contract

A standard rental contract can be very beneficial in protecting yourself and your tenant’s rights.  In a house for rent and other things that are for rent, the renter will be required to pay a security deposit or a certain amount of money.  This amount will be kept by the renter as an insurance policy that will be given to him at the end of his tenancy.  But, he should make sure that there are not defects in the house.  When you think of renting a house, a rental contract is a document that will assure your landlord to keep your security deposit.  Majority of these landlords have more detailed rental contracts than the others but it is essentially a binding contract that renters should take note of.

 

Alternatively, the landlords should also keep the property and the entire area in good condition, fix all the damages in every part of the house and monitor the possible issues of the house.  It is the main responsibility of the landlords to take actions instantly to all the concerns in his property.  This is one way of submitting to the healthy and safety regulations imposed by the federal government under the Landlord’s responsibilities.  If you fail to do this, you will surely encounter legal issues later on.  And this can ruin the professional relationship with your tenants.

Hopefully, you rental contract must include your actual scenario, or the tenant is supportive, if not it will all rely on the legal counsel and the right bylaws as to what is the right punishment.  If ever there is an immediate and unexpected need to temporarily leave the house, tenants will normally try to sub-lease their house while they are not around.  In this manner, they can get back the security deposit as soon as their contract ends.

In a standard rental contract, landlords must state if the renters are allowed to bring pets, smoke inside the house and identify the exact due date for the monthly rent.  If ever there will be late payments, the late charges must also be specified in the contract.  Even the computation of such charges should also be stated.  This will help the both parties clarify things in the future.  The period of tenancy can end in different cases such as:

  • Pay or Quit Notice from non-payment;
  • Cure or Quit Notice- if you made something you formerly arranged not to when you confirmed the rental contract of if other renters have complaints against you;
  • Non-eviction Move out Notice- which as an open contract that can allow them to improve your house or accept a new renter.

An evictee has the right to counter claim the complaints of the landlord since this is stated in his rights as a tenant.  But, you can choose to deal with all the issues concerned if he pays the rent in full amount.  This can be helpful to resolve the case in a peaceful and orderly manner.
