Parts & Materials: The materials expected to be be used for the work. Most times this read straight off from the detailed estimate sheet made for the job bid. Again, the more detail, the better.

Cost: The entire price for the body of work to be performed. Includes breakdowns for labor and materials.

Project Location: the place where the project is to be executed. This includes in the construction contract the official tract description, plat layout and survey maps as required.

Start & CompletionDates: The specified timeframe to finish the project, with specified dates.

Payment Schedule: How payments will be performed and the milestones required for payments.

Change Orders: How changes to the scope of schedule, materials or work will be dealt with. This is a critical area, because there are always changes in every job.

Penalties: Any penalties for incomplete payments, incomplete work, etc.. These penalties are commonly as required by law as well as specific penalties agreed to by both parties.

Arbitration: Where and how differences of opinion will be dealt with. Normally mediation by a third party is the remedy.

A breach of contract is defined as a condition where one company fails, for whatever reason, to perfom according to the specs of the contract.


How Construction Contracts Come To Be Terminated

Construction contracts can be terminated due to many reasons. It can be as plain as the project being succesfully accomplished to the satisfaction of all entities. Or there could have been a breach of contract by one side, allowing the other company to be released from the contractual obligations.Both sides can mutually decide to terminate the contract. Unanticipated conditions beyond the control of either company can be cause for contract termination.
